This Privacy Policy applies to Nilbon Yoga and our websites (hereinafter, "us", "we", or “Nilbon Yoga”). We respect your privacy and are committed to protecting personally identifiable information you may provide us through the Website. We have adopted this privacy policy ("Privacy Policy") to explain what information may be collected on our websites and through your allocated therapist, how we use this information, and under what circumstances we may disclose the information to third parties.

This Privacy Policy, together with the Terms and conditions posted on our Website, set forth the general rules and policies governing your use of our Website. Depending on your activities when visiting our Website, you may be required to agree to additional terms and conditions.

We undertake to preserve the confidentiality of all information you provide to us and the fact that such information is protected under relevant Data protection Policies/Acts. Our policy complies with the Data Protection Act 2018 (Act) accordingly incorporating the EU General Data Protection Regulation (GDPR).

Acceptance of privacy policy 

By accessing and using our website and service, you agree that you have read, understood and accept all the contents of this Privacy Policy. If you do not agree with or you are not comfortable with any aspect of this Privacy Policy, you should immediately discontinue access or use of the site and our Services.

Your identity includes information such as first name, last name, title, gender, date of birth, medical report/record and other identifiers that you may have provided at some time.

Your contact information includes information such as billing address, email address, emergency contact, telephone numbers, GP’s contact information and any other information you have given to us for communication with you and other relevant third parties such as health care professionals.

Your financial data includes information such as your payment details (Visa/master card details or PayPal).

Transaction data includes details about payments or communications to and from you, purchases or orders made by you, and information about the services you have purchased.

Technical data includes your internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.

Marketing data includes your preferences in receiving marketing from us; communication preferences; responses and actions about your use of our services, your interests and feedback and survey responses.

You may be required to provide more information to us in order for us to provide our services to you. Such information may be requested when you fill out our health questionnaires or during your sessions with one of our therapists. You hereby warrant to provide any such information as at when required and that such information shall be accurate and true.

Information we process because we have a contractual obligation with you

When you use our service and/or website or otherwise agree to our terms and conditions, a contract is formed between you and us.

In order to carry out our obligations under that contract or where we have a legitimate reason to such as but not limited to recover debt due to us or keep our records update or simply to improve our services, we must process the information you give us. Some of this information may be personal information.

We may use it in order to:

  • verify your identity for security purposes

  • process your order

  • provide you with our services

  • Improve our services 

  • make payments

  • to study how you use our service and grow our business

  • to comply with legal obligations

  • provide you with suggestions and advice on our services and how to obtain the most from using our website.

We process this information on the basis there is a contract between us, or that you have requested we use the information before we enter into a legal contract.

We shall continue to process this information until the contract between us ends or is terminated by either party under the terms of the contract. Nilbon Yoga may disclose potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organisations that (i) need to know that information in order to process it on Nilbon Yoga’s behalf or to provide services available on our website, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organisations may be located outside of your state or country. By using our website and/or service, you consent to the transfer of such information to them. Nilbon Yoga will not rent or sell potentially personally identifying and personally identifying information to anyone. Other than to its employees, contractors and affiliated organisations, as described above, Nilbon Yoga may also disclose potentially personally-identifying and personally-identifying information in response to a subpoena, court order or other governmental requests, or where Nilbon Yoga believes in good faith that disclosure is reasonably necessary to protect the property or rights of Nilbon Yoga, third parties or the public at large. Should our therapists fear that clients may be at risk of harming themselves or others, they may need to share information with relevant authorities or medical or mental health professionals. The therapists may also anonymously share details of their meetings with clients with supervisors simply to improve the service provided to you and to collect expert opinions. This disclosure shall be anonymous with no reference to you personally.

When you signup to use our service, you may be required to have a thirty (30) minutes consultation with one of our therapists and director. At the meeting, your allocated therapist will be present together with the director for Nilbon Yoga. While the director will only be present for the initial 15 minutes of the meeting, you may opt-out or request that the director not be present for this meeting, More so, you will be required to fill out our health questionnaire before this meeting. This questionnaire may contain some personally identifiable information. Our director and therapists may have access to such information in order to process this and you may be required to discuss the information provided further with your assigned therapist during the consultation meeting. Should there be some information you do not want the director to be informed about or wish not to be discussed in front of the director during your consultation, kindly notify your therapist. For 1-to-1 sessions, clients will be required to discuss their health questionnaire with their assigned Yoga therapist during the 1st session.

If you are a registered user of Nilbon Yoga and have supplied your email address, we may occasionally send you an email to tell you about new features, newsletter, solicit your feedback, or just keep you up to date with what’s going on with Nilbon Yoga and other fitness information. We shall keep this type of email to a minimum. 

If you send us a request (for example via a support email or one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Nilbon Yoga takes all measures reasonably necessary to protect against the unauthorised access, use, alteration or destruction of potentially personally identifying and personally identifying information.

Information we process with your consent

Through certain actions when otherwise there is no contractual relationship between us, such as when you browse our website or ask us to provide you more information about our business, including our services, you provide your consent to us to process information that may be personal. Wherever possible, we aim to obtain your explicit consent to process this information, for example, by asking you to agree to our use of cookies or to fill out our health questionnaire. If you have given us explicit permission to do so, we may from time to time pass your name and contact information to selected associates whom we consider may provide services or products you would find useful. Information relating to your method of payment

As a user who has ordered our service through our website, we may store information about your debit or credit card or other means of payment when you first provide it to us through our payment gateway or on your profile. How long will you hold data about you? 

Data provided to us are kept and used in providing services to our client or as maybe necessary for our legitimate interest (such as to develop our website and develop our business). We will only ever retain such data for as may be required to fulfil the purposes we collected it for or to provide our services to you. The period or how long we retain d specific data after the termination of service shall vary depending on the data and will ultimately be kept for a maximum period of 6 months or as maybe required by law.

We collect data about your activities that does not personally or directly identify you when you visit our website, the website of entities for which we serve advertisements (our “Advertisers”), or the websites and online services where we display advertisements (“Publishers”). Other analytics software may include Squarespace where we host our website. They may also collect some information while you use the website. Please note that we are not in control of this analytics software and the use of the information received through this software.
